Consensual Relationship Harassment केरल हाई कोर्ट का कहना है कि पहले से शादीशुदा महिला से शादी करने का वादा रेप केस का आधार नहीं बन सकता है। जस्टिस कौसर एडप्पागथ की पीठ ने बलात्कार के एक मामले को खारिज करते हुए यह टिप्पणी की।अभियोजन पक्ष के अनुसार, याचिकाकर्ता-आरोपी ने पीड़िता से शादी का झूठा वादा करके कई मौकों पर उसका यौन शोषण किया। सुनवाई के दौरान कोर्ट ने कहा कि दर्ज किए गए बयानों से पता चलता है कि पीड़िता ने मर्जी से अपने प्रेमी के साथ संबंध बनाए थे।

  • Consensual Relationship Harassment अदालत ने आगे कहा कि यह तय है कि यदि कोई पुरुष किसी महिला से शादी करने के अपने वादे से मुकरता है, तो सहमति से किया गया यौन संबंध IPC की धारा 376 के तहत अपराध नहीं माना जाएगा, जब तक कि यह साबित नहीं हो जाता है कि संबंध बनाने के लिए सहमति उसने शादी का झूठा वादा करके प्राप्त की गई थी, जिसका पालन करने का उसका कोई इरादा नहीं था और किया गया वादा उसकी जानकारी के लिए झूठा था। इसके अलावा धारा 417 और 493 के अपराध को साबित करने के लिए कोई सबूत नहीं है।

  • Consensual Relationship Harassment विवाहित होने के बावजूद महिला अपने पति से अलग रह रही है और तलाक की कार्यवाही भी चल रही है। आरोपी के खिलाफ मामला खारिज करते हुए अदालत ने कहा कि सहमति से बनाए गए संबंध सेक्सुअल हैरेसमेंट नहीं है, इसलिए मामले को आगे बढ़ाने से कोई उद्देश्य पूरा नहीं होगा। आरोपी और पीड़िता ऑस्ट्रेलिया में सोशल मीडिया के जरिए मिले और उनका रिश्ता लव अफेयर में बदल गया और उन्होंने शादी करने का भी फैसला किया। हालांकि, शादी नहीं हो पाई। महिला के अनुसार, उसने आरोपी के शादी के वादे पर भरोसा करके सेक्स के लिए सहमति दी थी। 2018 में थंकाचन के खिलाफ पुनालूर पुलिस स्टेशन में मामला दर्ज किया गया था।
