Sexual Harresment Law साल 2013 से पहले भारतीय संविधान की धारा 354 के तहत कोई भी अगर सेक्सुअल हैरेसमेंट के खिलाफ थाने में शिकायत दर्ज करवाता था और आरोप सिद्ध होते थे तो उसे आईपीसी की धारा के तहत एक साल से लेकर 5 साल की सजा हो सकती थी, चाहे मामला कोई भी हो। 2013 के बाद इस कानून में काफी बदलाव किए गए हैं। अब सेक्सुअल हैरेसमेंट को चार धाराओं में बांटा गया है। धारा- 354-A, धारा- 354-B, धारा- 354-C, धारा- 354-D।
क्या कहती है धारा 354-A?

इसके तहत वो मामले आएंगे जिसमें किसी महिला के साथ जबरन शारीरिक संबंध बनाने की कोशिश की गई हो, उसे गंदी नीयत से टच किया गया हो, अश्लील मैसेज भेजे गए हो या फिर गंदे कमेंट किए गए हों।अश्लील वीडियो दिखाने को भी इसी धारा के तहत लिया गया है। ऐसे आरोपों के साबित होने पर तीन साल की सजा और जुर्माना भी लगाया जा सकता है।
धारा- 354-B के तहत 7 साल तक की सजा

धारा 354-B के तहत अगर कोई शख्स किसी महिला को जबरदस्ती कपड़े उतारने पर मजबूर करता है, या फिर उसपर कपड़े उतारने का किसी भी तरह से दवाब बनाता है या फिर जबरदस्ती उसके कपड़े उतारता है तो उसे इस धारा अंतर्गत 5 से लेकर 7 साल तक की सजा हो सकती है। ये धारा नॉन बेलएबल यानी गैर जमानती है।
अश्लील वीडियो बनाना यौन उत्पीड़न
Sexual Harresment Law 354-C के तहत ऐसे केस आते हैं जब किसी महिला का अश्लील वीडियो बनाया जाता है।इसके अलावा महिला के किसी प्राइवेट काम को पब्लिकली फैलाना भी इस धारा के तहत शामिल किया गया है। लड़की ऐसे आरोपों के खिलाफ शिकायत दर्ज करवा सकती है और दोषी पाए जाने पर आरोपी को 3 साल की सजा का प्रावधान है।
धारा 34-D के तहत 3 साल की मिनिमम सजा

34-D में स्टालकिंग यानी जबरदस्ती लड़की का पीछा करना शामिल है। इसके अलावा लड़की की मर्जी के बिना कोई उससे जबरदस्ती कॉनटेक्ट बनाए रखने की कोशिश करता है तो भी लड़की इस धारा के तहत अपनी शिकायत दर्ज करवा सकती है। इस धारा के तहत केस पर आरोपी को 3 से लेकर 5 साल की सजा मिल सकती है और साथ ही जुर्माना भी लगाया जा सकता है।
